جدید ریاستوں میں اسلامی قانون کی تشکیل نو کے لیے تاریخی تناظر میں اسلامی قانون کے ارتقائی تصور کو سمجھنا ضروری ہے اوراس کے لیے اسلامی قانون کے ارتقاء کو درج ذیل چار مراحل میں تقسیم کرناہوگا۔

پہلے مرحلے میں نزول قرآن سے آغاز کریں توکسی بھی صورت یونانی قانون کااسلامی قانون سے کوئی تعلق نہیں بنتا یہ سب من گھڑت داستان ہے۔پہلی صدی کے اختتام اوردوسری صدی کے آغاز میں اسلامی قانون کے ارتقاء میں فقہاء نے جوکرداراداکیا اسے مشکوک کیاجاتاہے حالانکہ فقہ واصول الفقہ کی مکمل بنیاد قرآن وسنت پر رکھی گئی۔ اس لیے پہلے مرحلے کاتعلق مستشرقین کے من گھڑت اعتراضات وافسانوں سے ہے۔
دوسرامرحلہ جوطویل ترین مرحلہ ہے یہ مرحلہ تقریباپہلی بارہ صدیوں پر مشتمل ہے۔ اس دوران اسلامی قانون کاارتقاء معاشرے سے گہرے ربط کی وجہ سے ایک زندہ قانون کے طور پر ہوااوریہ نہ صرف اسلامی تاریخ بلکہ دنیا کی تاریخ کا سنہرا ترین دور ہے۔
